Privacy Notice for Visitors and Contact

Laboratorios Sophia, S.A. de C.V. (“Laboratorios Sophia” and/or “The Controller”), with address at Avenida Paseo del Norte 5255, Guadalajara Technology Park, Zapopan, Jalisco, C.P. 45010, is responsible for collecting your personal data, the use that is given to it and its protection. For this reason, below, based on the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter “The Law”) and its Regulations and with respect to the right of every person to privacy and to informational self-determination, we make available to you this Privacy Notice, the purpose of which is to explain why we require your data, as well as the type of data that will be collected and the treatment that will be given to it. Likewise, the procedures that you can use to exercise your rights of access, rectification, cancellation and opposition, better known as “ARCO Rights”, are explained.

PURPOSE

At Laboratorios Sophia we collect, store, use, transfer and share the personal data that you have provided to us when you visit our facilities, contact us by any means, whether physical or digital, call us by phone, write an email, visit us or use our website, and/or social networks; request information from us, purchase our products and/or hire our services. Your data may be collected directly by us or through other sources, and/or by third parties on our behalf.

WHAT ARE THE PERSONAL DATA THAT WE COLLECT AND USE?

The processing of the personal data of the people who contact us and visit us by any means is carried out for the fulfillment of the commercial purposes that unite us. To do this, we have technological, physical and administrative means to take care of, limit the use and disclosure of your data.

The data we will collect from you may be: Full name, country, city, current official identification (INE, passport, driver’s license, professional ID and/or military ID), address, email, landline or cell phone number; social networks, WhatsApp, car license plates, car model, digital or physical autograph signature; moving image (video), name of the treating physician and/or the matter for which you are contacting us. In the event of requesting the marketing of a product, please specify which line it is.

In the event that any of the aforementioned data is not necessary, we will not require it, except for those that are explicitly requested, since, if we do not have this information, we would not be able to correctly and satisfactorily fulfill the service we provide. Likewise, it is important to inform you that, if you do not provide your data correctly, we will not have any liability derived from this assumption.

We will not, under any circumstances, request personal data classified as sensitive, that is, personal data that is intimate or whose improper use may give rise to discrimination or entail a serious risk for you, such as racial or ethnic origin, current and/or future health status; genetic information, religious, philosophical and/or moral beliefs; trade union membership, political opinions and/or sexual preference. We ask that you please do not provide us with this type of data. However, if for any reason you do provide it to us, it will not be stored or processed by us.

FOR WHAT PURPOSES WILL WE USE YOUR PERSONAL DATA?

We inform you that we will use the personal data we collect from you for the following primary purposes:

  1. To be able to provide, offer and/or sell our products and/or services correctly, or, where appropriate, to answer any questions in this regard;
  2. To be able to identify you and/or contact you, regarding any commercial and/or legal relationship that we maintain;
  3. For the operation and activities of our internal administration;

If you do not wish for your personal data to be processed for secondary purposes, you may immediately state your refusal to such use, using the corresponding form that we will make available to you once you request it through our contact channels. Otherwise, we will understand that you have given us your consent for such uses.

WITH WHOM DO WE SHARE YOUR INFORMATION AND FOR WHAT PURPOSES?

We inform you that we will not transfer your personal data to third parties without your prior consent, unless otherwise expressly stated in this Privacy Notice. Third parties to whom your personal data is transferred will only receive those data that are essential to carry out their activities and/or for compliance. Given the above, we will only transfer your data in the following cases:

  • When the transfer is necessary or legally required to safeguard a public interest, or for the administration of justice;
  • When the transfer is necessary for the recognition, exercise or defense of a right in a judicial process;
  • When the transfer is necessary for the maintenance or fulfillment of a legal relationship between the controller and the owner.

Your personal data will not be transferred for purposes other than those mentioned in this privacy notice.

HOW LONG WILL WE KEEP YOUR DATA?

Once the Service has been performed or delivered without incident, within a period of 5 years after the last Service provided by us, your data will be deleted in accordance with the provisions of the applicable regulations, which implies its blocking, being available only at the request of authorities.

HOW CAN YOU ACCESS, RECTIFY, OR CANCEL YOUR PERSONAL DATA, OR OPPOSE ITS USE?

As a User, you have the right to know what personal data we have about you, what we use it for, and the conditions of use we give it (Access). Likewise, it is your right to request the correction of your personal information if it is outdated, inaccurate, or incomplete (Rectification); that we delete it from our records or databases when you consider that it is not being used appropriately (Cancellation); as well as to oppose the use of your personal data for specific purposes (Opposition). These rights are known as ARCO rights.

If you consider that your right to the protection of your personal data has been violated by any conduct or omission on our part, or you suspect any violation of the provisions set forth in the Law, its Regulations and other applicable regulations, you may file your complaint or complaint with the National Institute for Transparency, Access to Information and Protection of Personal Data (INAI). HOW CAN YOU REVOKE OR LIMIT YOUR CONSENT FOR THE USE AND/OR DISCLOSURE OF YOUR DATA?

You may revoke or limit your consent, if applicable, for the processing of your personal data. However, it is important that you bear in mind that we will not be able to respond to your request or terminate the use immediately in all cases, since it is possible that due to some legal obligation we may require to continue processing your personal data. WHAT SECURITY MEASURES DO WE USE TO PROTECT YOUR DATA?

We guarantee that your personal data will be treated under strict security measures, both administrative, technical and physical, which are provided for in the applicable regulations, as they are the most appropriate according to the type of personal data in question and the treatment to which they are subject, we guarantee their confidentiality at all times, avoiding unauthorized access, damage, loss, alteration or destruction of your personal data.

DO WE USE TRACKING TECHNOLOGIES ON OUR WEBSITE?

We inform you that on our website we use cookies, web beacons and other technologies through which it is possible to monitor your behavior as an Internet user, provide you with a better service and experience as a user when browsing our page, as well as offer you new products and services based on your preferences.
